Eat Well and Work Out is, and always has been, committed to ensuring the privacy and security of our customers’ personal information.

 

With the new regulations coming in from 25 May 2018 – the General Data Protection Regulation (GDPR) the intention behind this new rule is to give you more say over how companies such as ours use your data.

GDPR sits with our already stringent rules around data protection and client confidentiality.

Eat Well and Work out is a controller of your personal data.

We respect your personal data and your privacy is really important to us.

This Privacy Notice explains what personal data we collect and how it is used, and also explains what rights you have over your personal data and how you can use those rights.

1. Summary of how we use your data and your rights

We use your data to provide support and coaching in the process of your consultations and ongoing coaching with us, and for safety and security purposes. 

We will use your data to comply with laws and regulations.

You have the right to object to some of the processing Eat Well and Work Out carries out. More information about your rights and how to exercise these is set out in the “Your rights” section of this notice. 

When you give consent, you are able to withdraw that consent at any time, for instance by emailing james@eatwellandworkout.com.

You can also email james@eatwellandworkout.com to follow up any other data rights, such as obtaining a copy of your data, correcting, deleting or restricting how we use your data. 

You can unsubscribe from marketing communications at any time.  To opt out of marketing, including profiling for direct marketing purposes, you can either adjust the preference settings at the bottom of our emails, select “unsubscribe” in emails, or please email james@eatwellandworkout.com

Our websites use cookies. You can reject and block cookies in your browser settings.  

2. Information we collect from you

We collect information when you use our services from:

  • Relevant health records and data during consultations
  • PAR Q (Physical Activity Readiness Questionaire) during Personal Training

In particular:

  • Name, email, address and telephone number), comments, date of birth, gender, region, frequency of visits records and email to forward receipts and session trackers.
  • If there is an incident or issue, we may legally be required to log information about it.
  • If you engage with us online via our websites, our cookies and similar technologies will capture your IP address, where your browser or mobile settings or permission allows for this.
  • If you post information online, we may keep a record.
  • If you contact us directly and complain or give feedback, we will record details and all related information such as emails, letters and phone calls.

3. Information we receive from third parties

  • We do not share your data with third parties
  • Data shared at consultations is not shared across our colleagues without your specific consent or request.
  • We are required to hold a copy of your consultations for 7 years, yet will only share to any other parties without your written consent.

4. How we use information and the legal basis

We are allowed to use your data:

  • To fulfil a contract we have with you
  • When you consent to it
  • To comply with the law.

When the law requires us to process your data we will do so, including:

  • Legal, compliance, regulatory and investigative purposes, including for government agencies and law enforcement.
  • When you exercise your rights under data protection legislation, including when you ask to subscribe or unsubscribe from our marketing communications.

 

5. Data sharing

If our business is to be integrated with another business or sold, your details could be shared with our both parties.  Your information will be passed to the new owners and you would be notified

Personal data may be shared with government authorities and/or law enforcement officials for the prevention or detection of crime, if required by law or if required for a legal or contractual claim.

7. Cookies and similar technologies

Our website and marketing emails use cookies and similar technology.

8. Data retention

We keep your data to enable us to fulfil our contract with you or to provide services, whilst you are an active user of our services, where required by law or to protect legal rights.

For example, we keep:

  • Records of payment information in line with tax law requirements.
  • Information to maintain records according to rules that apply to us.
  • If you unsubscribe from marketing communications we keep a record of this request indefinitely to ensure we do not send you direct marketing again.

We may keep your data for longer if we cannot delete it for legal, regulatory or technical reasons.

9. Your rights

You have rights over your personal data.

You can ask for:

  • a copy of your information;
  • information to be corrected;
  • information to be erased or deleted;
  • us to limit or restrict processing;
  • feedback on any objection you have on how we use your data

Some rights, however, may be limited. We may be obliged by law or regulation to keep information. 

If you want a copy of your data, to object to how we use your data, or ask us to delete it or restrict how we use it or, please see ‘Contact details’ below.  To process a request from you, we may need to confirm your identity to ensure we’re accessing the right data.

You have a right to complain to an EU data protection authority.  This can be where you live, work or where the matter occurred. In the UK, the authority is the Information Commissioner’s Office (the “ICO”).
